Terms of Service
This document is the agreement between you and the company that runs Planye. Where a help page summarises it, this document governs.
The agreement
These terms are between you and Riquetti Studio, CNPJ 41.011.161/0001-68, Rua Rodriguês do Prado, 150, Ermelinda, Belo Horizonte, MG, Brazil. Making an account means you accept them. If you do not, the honest answer is not to make one.
What we do with what you write is a separate document, the Privacy Policy.
Planye is in beta
Beta here is a description, not a legal hedge. The app works, people use it daily, and it is also young: features change shape, pages get rebuilt, and a bug now and then reaches you before it reaches us.
Things may change. A module can be redesigned, renamed, or moved somewhere better. We will not remove one you are using without telling you first.
There may be downtime. Your planner keeps working offline while there is, because your device holds its own copy, and it syncs when we are back.
We take backups and we have never lost a reader's planner. We still will not pretend loss is impossible, and we would rather say that plainly than let a promise of safety stand in for one.
If we ever decide to shut Planye down, you get at least 90 days' notice by email, so that nothing goes without warning.
Planye+, and what happens to what you made
Planye has a free plan and a paid one called Planye+. The free plan is a real planner rather than a sample: the day, week, month and year, the journal, mood, budget and cycle logging have no time limit on them and never expire. Planye+ raises the limits on how much you can keep, opens the rest of the themes and decoration, and adds printing a page as a designed PDF and the Year in Review.
Before you pay, the page shows the price in your own currency, how often it renews, and the total. There is nothing added at the end.
It renews automatically at that price until you cancel. You can cancel at any time, in the same number of steps it took to subscribe, and it keeps working until the end of the period you have already paid for. We do not ask you why and there is nothing to write in.
Where you subscribed decides where you cancel, and it is the only thing it decides. Subscribe on our website and the payment, the renewal and the cancelling are ours, through Stripe, from your account panel. Subscribe inside the iPhone or Android app and Apple or Google is the seller: they take the payment, they renew it, and cancelling, changing plan and changing your card all happen on their own subscription screen, which the app links you to. Planye+ is the same Planye+ either way, on the same account, whichever device you open it on.
Brazilian consumer law gives you seven days to change your mind about anything bought at a distance, and we honour that wherever you live: write to contact@planye.com within seven days of a payment, we confirm at once that your request arrived, and we refund the payment in full. If you subscribed in the App Store or on Google Play, the refund is theirs to make rather than ours (we cannot reach a payment we never received), so ask them, and write to us if they refuse and you believe those seven days cover you.
Any other question or complaint about a purchase, sent to contact@planye.com, is answered within five days. Brazilian law on buying online (Decreto 7.962/2013) sets that deadline, and we keep to it wherever you live.
If a payment fails we do not cut you off that day. Your plan carries on while the card is retried, for fourteen days, and if it still has not gone through the account goes back to the free plan. A subscription bought in either store follows that store's own retry and grace period instead, for the same reason the refund does.
Closing your account does not cancel a subscription, and neither does deleting the app. Cancel it first, where you subscribed.
Here is exactly what happens to what you made if you stop paying, or if you were never paying. It is short, because there is only one rule.
Nothing you made is deleted. Not an entry, not a habit, not a budget month, not a journal page, not a photograph, not a sealed capsule. Being over a free limit has never been a reason to remove anyone's content and we do not have any code that would.
What happens instead is that anything over a free limit becomes read-only. If you kept eight habits and the free plan keeps five, all eight are still there and still yours: you can see them, and you can delete any of them, and the three over the line cannot be renamed or marked until you are back under it or back on Planye+. Journal media over the free allowance stays stored and stays downloadable; what pauses is adding more.
Subscribing again puts everything back at once. There is no restoring to do, because nothing was taken away.
Reading what you already made stays free. Whatever a free account can and cannot do, it can always open what it wrote and download its own journal media. Exporting a page as a designed PDF is a Planye+ feature.
If we ever change what a plan includes for an account that already has one, you get an email and a notice in the app at least 30 days before it takes effect, saying what changes and what it will cost. Nothing is ever charged retroactively.
Your account
One person, one account, and you are responsible for what happens under it. Keep the password to yourself, and tell us at contact@planye.com if you think someone else has it. You need to be at least 13, or 16 where local law says so.
Give us an address you can actually receive mail at. It is how you confirm the account, recover a lost password, and hear about the changes these terms promise you will hear about.
What you write stays yours
You own every word, figure and photograph you put into Planye. We claim no ownership of any of it, and nothing here transfers a right in your content to us.
To run the service we need a narrow permission, and it is worth saying where it ends. You grant us a licence to store your content, move it between your devices, back it up, and display it back to you. That licence exists only to operate Planye for you, it is not transferable to anyone else, and it ends when you delete the content or close the account.
It does not include, and will never be read to include, any of the following. We do not sell your content. We do not share it with advertisers. We do not use it to train a machine-learning model, ours or anyone else's. We do not publish it, mine it for product ideas, or read it for anything other than a support request you asked us to look at.
What you agree not to do
Short list, and none of it will surprise you. Do not use Planye to store or distribute anything unlawful, particularly material that sexualises a child. Do not attack the service, work around its limits, or try to reach another account. Do not resell access to it or scrape it wholesale. Do not upload someone else's content that you have no right to upload.
Journal media has size limits and the service is sized for one person's planner. Using it as a general file host is the one thing on this list we might notice before you do.
What Planye is not
Planye draws what you tell it and does the arithmetic. It does not know anything about your situation, and three of its modules sit close enough to real advice to be worth naming.
Cycle is not a medical device or a contraceptive. It records what you enter and shows the pattern back. It does not predict fertility, it must not be used to prevent or plan a pregnancy, and it is no substitute for a doctor.
Mood is not a diagnosis. It is a log. If you are struggling, please talk to someone qualified rather than to a planner.
Money is not financial advice. Budget adds up the figures you typed. It does not check them against a bank, and it does not recommend anything.
Ending it, from either side
You can stop at any time. Deleting the account removes your planner on the timeline the Privacy Policy sets out, and it is worth reading that timeline before you press it, because after it nobody can put any of it back.
We can suspend or close an account that breaks the clause above, or where a law requires it. Except where the breach is serious enough that we cannot, we will tell you why first, give you a chance to put it right, and leave you 30 days before anything is removed.
What we are and are not answerable for
Planye is provided as it is. During the beta we make no warranty that it will be uninterrupted or error-free, and we disclaim implied warranties to the fullest extent the law allows.
Where a limit on liability is permitted, ours is capped at the greater of what you have paid us in the twelve months before the claim and fifty Brazilian reais, and we are not liable for indirect or consequential loss.
Two carve-outs, and they are real rather than decorative. None of this limits liability for fraud, wilful misconduct, or anything else a law does not allow to be limited. And if you are a consumer under the Código de Defesa do Consumidor or an equivalent law where you live, that law wins over this clause wherever the two disagree.
Which law applies
These terms are governed by the laws of Brazil, and the courts of the company's registered seat are the usual place for a dispute.
If you are a consumer, that does not take away the protections of the law where you live, or your right to bring a claim in your own courts. Brazilian consumer law says the same, and we would rather settle anything by email at contact@planye.com than in front of anyone.
If these terms change
We will publish a new version, dated, with a note saying what changed. Material changes come with an email and a notice in the app at least 30 days ahead, and continuing to use Planye after that is how you accept them. If you would rather not, you can close the account before the change takes effect.
